Terms of Service

Welcome. These Terms of Service ("Terms") govern your use of the Airplane Mode trip portal service ("Service") operated by SweeneyWorldwide LLC ("we," "us"). By creating an account or purchasing a Passport, you agree to these Terms.

1. THE SERVICE

Airplane Mode is a personalized, mobile-first trip portal SaaS. Each Passport grants one person access to one trip portal with itinerary, hotels, food, map, packing list, document scanner, and AI travel companion features. Some features (live GPS, proximity alerts) require explicit opt-in.

AGE REQUIREMENT

You must be at least 18 years old to create an account, purchase a Passport, or use the Service. By signing up or buying, you confirm that you are 18 or older and able to enter into this agreement. The Service is not intended for anyone under 18. Some content we surface (for example bars, nightlife, wineries, or distilleries) may reference activities restricted by age; you are responsible for verifying and following the legal drinking and purchase age and other local laws that apply to you.

2. PASSPORTS

• A Passport costs $25 USD per person, per trip for trips up to 14 days, or $35 USD per person, per trip for trips of 15 days or more. Length is determined by the start and end dates entered at purchase.
• Passports are one-time purchases, not subscriptions.
• A Passport is permanently bound to the email of the user who claims it. Passports are non-transferable after claim.
• A buyer may purchase multiple Passports and distribute claim links to recipients. Distribution itself is free; the recipient claims with no additional charge.
• Alternatively, a trip's invite link allows others to join by purchasing their own Passport at the trip's locked-in tier price.

3. REFUNDS

• All Passport purchases are final. Because the Service is delivered instantly and a Passport unlocks the full portal the moment it is claimed, we do not offer refunds.
• Nothing you buy is wasted. Any Passport you prepaid and have not assigned stays in your account and can be gifted to anyone, anytime, with a free claim link. Extra seats never expire.
• Evaluate before you buy. Browse the public landing page and the live demo portals to see exactly what a Passport includes before purchase.
• Unauthorized or fraudulent charges are handled through your card issuer and Stripe in the usual way. Questions: support@airplanemode.travel.

4. ACCOUNT RESPONSIBILITIES

• You're responsible for the accuracy of information you submit.
• You must use a real email address you control. Sign-in codes are sent to that email.
• Do not share account access. Each person needs their own Passport.
• You're responsible for activity that occurs under your account.
• Notify us promptly if you suspect unauthorized access.

5. ACCEPTABLE USE

You agree not to:

• Use the Service for unlawful purposes.
• Attempt to bypass security, rate limits, or access controls.
• Scrape, copy, or reverse-engineer the Service.
• Upload content that is illegal, infringing, threatening, defamatory, or harmful.
• Use the AI companion to generate harmful, deceptive, or abusive content.
• Resell, sublicense, or commercialize Passports without our written agreement.

6. CONTENT YOU UPLOAD

You retain ownership of trip details, documents, and content you upload. You grant us a limited license to store, process, and display that content as needed to operate the Service. We don't claim ownership of your content and we don't use it to train AI models or for advertising.

7. THIRD-PARTY SERVICES

The Service integrates with third-party providers (Stripe for payments, Supabase for data storage, Anthropic for AI, Google for image generation, Cloudflare for security, Resend for email). Your use of those services through Airplane Mode is also governed by their respective terms. We're not responsible for the actions or policies of these third parties.

8. AFFILIATE LINKS

Some recommendations in the Service (packing list items, hotel suggestions, food guides) include affiliate links. We may earn a commission on purchases made through these links. This does not affect the price you pay. We only recommend products we believe are worth recommending; we don't recommend things solely because they pay a commission.

9. AI COMPANION DISCLAIMER

The AI travel companion provides suggestions and information that may not always be accurate. Independently verify time-sensitive or critical information (visa requirements, vaccination needs, restaurant hours, transportation schedules) before relying on it. We are not liable for decisions made based on AI-generated content.

10. WARRANTIES & LIABILITY

The Service is provided "as is" and "as available". To the maximum extent allowed by law, we disclaim all warranties - express or implied - including merchantability, fitness for a particular purpose, and non-infringement.

In no event will our total liability exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. CHANGES TO THE SERVICE OR TERMS

We may modify the Service or these Terms. Material changes to Terms will be communicated by email to all active users at least 30 days before taking effect. Continued use after changes means you accept the updated Terms.

12. TERMINATION

You may delete your account at any time by emailing support@airplanemode.travel. We may suspend or terminate accounts that violate these Terms, with or without notice. Refunds for active services are not guaranteed on termination for cause.

13. GOVERNING LAW

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Sacramento County, California.
